How America's Intelligence State Outlived the Enemy It Was Built to Defeat
How a decade of postwar law placed an intelligence agency beyond the reach of the vote—and why it never came back.
THE ARCHITECTURE OF PERMANENCE
On April 25, 1947, Allen Welsh Dulles appeared before the Senate Armed Services Committee with a vision for the intelligence service the United States was preparing to build.
It should be predominantly civilian, he argued. If its director came from the military, that person should leave military identity behind rather than treat intelligence work as another step in a service career. Senior officials, Dulles suggested, should effectively “take the cloth” of intelligence service, dedicating themselves entirely to the institution they were creating.
Behind closed doors, he offered another warning. The new agency, he insisted, must never become “a great big octopus.”
Keep it small. Keep it disciplined.
A handful of skilled officers, he argued, could accomplish more than a sprawling bureaucracy. Reflecting on his wartime experience running the Bern station in Switzerland, Dulles remarked that 10 capable people had achieved more than 50 ever could.
It was a remarkably restrained vision. Six years later, Allen Dulles became Director of Central Intelligence.
He would remain there for eight years, longer than any of his predecessors or successors. During that tenure, the agency he once urged Congress to keep limited directed the operations that overthrew the governments of Iran in 1953 and Guatemala in 1954 while expanding the covert-action machinery whose growth he had once cautioned against.
The man who warned against the “octopus” ultimately became its head.
This is not an argument about personal hypocrisy. It is an observation about institutional evolution.
The gap between what Dulles originally described and what the agency became within a decade reveals something far more enduring than one man’s changing views. The Central Intelligence Agency was built to survive:
Changing administrations
Changing political priorities
Conflict that justified its creation
It acquired the characteristics every durable institution seeks: continuity across elections, insulation from public pressure, and a mission protected by the language of national security. Within a few years, it possessed the authority to influence governments abroad while remaining largely beyond the reach of the electorate at home.
That architecture proved far more permanent than the Cold War itself.
BEFORE LANGLEY
The worldview behind that institution did not begin at CIA headquarters.
Long before Allen Dulles entered government, he spent three decades as a partner at Sullivan & Cromwell, the influential Wall Street law firm where he and his brother, John Foster Dulles, represented many of the multinational corporations shaping the interwar economy. Their clients included:
Mining interests across Latin America
Oil companies operating in the Middle East and Colombia
Industrial cartels linking American and European businesses
United Fruit Company
The latter was an organization whose Guatemalan land holdings John Foster personally helped negotiate during the 1930s. The firm’s business revolved around interests that crossed national borders and answered to shareholders rather than voters.
When the Dulles brothers entered government, John Foster as Secretary of State and Allen as Director of Central Intelligence, they did not simply leave that world behind. In many respects, they carried its perspective with them.
Historian Stephen Kinzer has documented how many of the agency’s earliest interventions occurred in countries where Sullivan & Cromwell clients maintained substantial business interests, including Iran, Guatemala, and later Cuba. Both brothers also owned United Fruit stock during the Guatemalan operation.
None of this proves that individual covert actions were conducted solely on behalf of private clients. Governments act for multiple reasons simultaneously, and anti-communism was unquestionably a genuine strategic conviction throughout the early Cold War.
What the historical overlap demonstrates is something more subtle.
The same individuals who had spent decades managing international commercial interests now occupied positions directing American foreign policy and intelligence. Their professional experiences naturally shaped how they interpreted national interests, strategic priorities, and geopolitical threats.
The architecture taking shape combined diplomacy, finance, intelligence, military power, and international commerce within a relatively small circle of policymakers whose experience already transcended national borders.
That perspective would leave a lasting institutional imprint.
THE ONE EXEMPTION
The Central Intelligence Agency formally came into existence through the National Security Act of 1947, signed by President Harry Truman on July 26 of that year.
That law established the agency. It did not yet place it beyond ordinary public accounting. That change came two years later.
The Central Intelligence Agency Act of 1949 quietly supplied the institution’s financial architecture, and one provision in particular transformed the relationship between the agency and the rest of the federal government.
Section 8(b) authorized the Director of Central Intelligence to expend funds “without regard to the provisions of law and regulations relating to the expenditure of Government funds,” while permitting those expenditures to be accounted for “solely on the certificate of the Director.”
Every other federal agency creates a documentary trail that auditors can examine. The CIA received something different. The certificate became the audit.
The same statutory framework also exempted the agency from many disclosure requirements that applied elsewhere across government. Under what is now codified as 50 U.S.C. § 3507 (formerly §403g), the CIA was relieved from laws requiring publication of its organizational structure, official functions, personnel names, titles, salaries, and staffing levels.
Most federal agencies publish organizational charts, employee counts, and salary schedules. The CIA was legally excused from doing so.
The Government Accountability Office (GAO) later described the consequence in testimony before Congress. The unvouchered account established under the 1949 Act became the single explicit exemption from the GAO’s normal audit authority. Over time, the agency interpreted that statutory language as excluding those expenditures from outside financial review altogether, and by the early 1960s the GAO had largely ceased attempting to audit them.
One arm of the federal government was prevented from examining another. Not through defiance. Through legislation. That distinction matters because it illustrates that the architecture was not constructed in secret. It was enacted openly by elected representatives who concluded that intelligence work required extraordinary secrecy.
Whether that judgment was justified is a legitimate question. The institutional consequences are undeniable.
For the first time, a civilian agency received statutory protection, placing significant portions of its finances, organizational structure, and personnel beyond the ordinary mechanisms of public accountability.
Years later, the man who signed those laws began expressing concern about what they had created.
Writing in The Washington Post on December 22, 1963, former President Harry Truman observed that the CIA had drifted far beyond its original purpose. Rather than remaining an intelligence service supporting presidential decision-making, he argued, it had become an operational and, at times, policy-making arm of government. Truman called for the agency to return to its original mission and for its operational responsibilities to end.
The creator had become the critic. His warning went unheeded.
WHEN STRUCTURE BECOMES CAPABILITY
A financial exemption, by itself, accomplishes very little. Its significance lies in what it allows an institution to build.
The methods of covert action already existed before 1949. What the CIA Act supplied was something more durable: a permanent financial mechanism capable of sustaining, expanding, and protecting those operations from the normal scrutiny applied elsewhere across government.
The demonstration had already begun.
In the spring of 1948, as Italy prepared for a pivotal national election, American policymakers feared that a victory by the Popular Democratic Front would pull the country into the Soviet sphere only weeks after the communist takeover of Czechoslovakia.
On March 8, the National Security Council issued NSC 1/3, directing American agencies to intensify anti-communist operations throughout Italy using “all feasible means.”
What followed became the template for decades of covert political intervention.
THE QUESTION TURNED INWARD
This is where history meets the present.
It is also where the line between documented evidence and informed inference matters most. What the historical record establishes should be stated plainly. What it does not establish should remain an open question.
The documented record shows that the methods described throughout this investigation:
Covert funding
Coordinated propaganda
Cultivation of political clients
Framing contested elections as struggles over legitimacy itself
—were developed and employed by American intelligence abroad over decades. Those operations are reflected in declassified files, congressional investigations, and an extensive body of historical scholarship.
The history is not in dispute. The record also reveals another continuity: the careers of the people who built and later inherited that architecture. Personnel moved along familiar paths, from intelligence agencies to congressional committees, from committee staffs to think tanks, from think tanks to advisory boards, and from there into organizations dedicated to defending democratic institutions.
The individuals changed. The institutional worldview often did not.
After 2016, when a presidential candidate challenged long-standing assumptions surrounding:
NATO
International trade
Intelligence assessments
Authority of permanent national-security institutions
An unusually large number of former intelligence directors, retired officers, ambassadors, and senior military leaders entered public political debate in ways their predecessors rarely had.
They organized • They signed open letters • They formed advocacy groups.
Organizations such as The Steady State, founded by former intelligence professionals, emerged explicitly to participate in that public conversation.
That continuity can be documented. There is another continuity that deserves equal attention.
The intelligence architecture developed overseas relied not only on money or covert relationships. It also relied on a particular framing method for political contests. Elections were increasingly presented as civilizational moments in which one outcome represented survival while the other represented catastrophe.
During Italy’s 1948 election, American messaging portrayed the contest not simply as a democratic choice but as a struggle between prosperity and collapse, between Western aid and national ruin. The election itself became a national security concern requiring extraordinary attention.
That pattern of framing forms one of the most recognizable elements of the historical record. It is also the element most visibly echoed in contemporary public statements.
Steven Cash, executive director of The Steady State, titled one essay “Two Existential Threats: CIA’s Reputation vs. Democracy’s Survival.“ More than 200 former diplomats and intelligence officials signed a public letter warning of an “Assault on American Democracy.”
Whether one agrees with those assessments is not the point. The recurring vocabulary is.
“Existential threat.”
“Democracy’s survival.”
“Assault on the Republic.”
This is not the language of ordinary policy disagreement. It is the language of emergency. That continuity of rhetoric can be demonstrated from publicly available documents on both sides of the historical timeline.
The people using that language appear sincere. Their sincerity, however, does not answer the constitutional question.
Many spent distinguished careers in public service and genuinely believe they are defending democratic institutions. But institutions do not become publicly accountable simply because the people serving within them believe they are acting honorably.
Good intentions do not replace constitutional oversight. That is precisely why republics distribute power rather than concentrating it in any one institution or profession.
The question has never been whether those involved believe they are serving the public. The question is whether the public still possesses meaningful mechanisms for holding permanent institutions accountable.
At this point, the historical record reaches its limit.
What can be documented is the continuity of personnel.
What can be documented is the continuity of institutional language.
What cannot presently be documented is a comparable continuity of covert operational methods directed inward against the American electorate.
That distinction matters enormously. The historical record raises the question. It does not yet answer it. Recognizing that limit is not an act of timidity. It is what separates durable historical argument from speculation.
A careful reader who has followed the documented progression from Rome to Tehran to Guatemala City and then compares those historical methods with contemporary public statements is entirely capable of drawing personal conclusions.
The author’s responsibility ends at presenting the record faithfully. The judgment belongs where it always has. With the citizen.
WHAT THE FOUNDERS FEARED
The larger constitutional question extends beyond the Central Intelligence Agency itself. It reaches back to the founding principles of the American republic.
In the constitutional system, legitimacy is intended to flow upward. Citizens choose representatives, representatives govern, and government remains accountable to those who elected it.
The architecture examined throughout this investigation raises a different question.
“Has legitimacy increasingly migrated toward permanent institutions that persist across administrations, possess knowledge unavailable to the public, spend funds shielded from ordinary review, and increasingly describe criticism of themselves as criticism of democracy itself?”
George Washington’s Farewell Address warned against the accumulation of concentrated power and the dangers posed by permanent foreign entanglements. He spoke to the circumstances of his own century, yet the underlying principle remains recognizable.
The architects of the postwar national-security state confronted genuine dangers the Founders could scarcely have imagined. Many sincerely believed that defeating Soviet expansion required institutions possessing authorities and capabilities unknown to earlier generations.
They were not wrong about the dangers. What they created, however, was an institutional framework granted statutory exemptions from many of the mechanisms through which constitutional government traditionally holds power accountable.
Those exemptions remain in force today. The Cold War does not.
Allen Dulles asked Congress to build an intelligence service that remained small, disciplined, and civilian. It did not remain small.
Harry Truman later warned that the institution he had created had drifted beyond intelligence gathering into operations and policy. His warning was never fully answered.
Each successive emergency simply postponed the question for another generation.
The creator became the critic. The architecture endured. Republics rarely surrender self-government through a single dramatic event.
More often, authority shifts gradually through:
A statute
A temporary exemption
A new emergency
A reasonable accommodation
Each individual decision appears prudent in isolation. Viewed across decades, however, those incremental decisions can fundamentally reshape the relationship between citizens and the institutions acting in their name.
That is the story traced here. Not of power seized. But of power granted. Not through conspiracy. Through legislation.
The encouraging conclusion is that what was created through law remains subject to law. The statutes remain public. The history remains documented. The careers remain traceable.
A self-governing people possess the same authority to examine, question, and reconsider institutional arrangements that previous generations possessed when they created them. Every constitutional republic depends upon that willingness.
The first step toward reclaiming any authority gradually surrendered is understanding, with honesty and precision, how it was surrendered in the first place.
Liberty. Transparency. Truth. Justice.
